Terms of Service

• "App" refers to the AstroBella mobile application, including all its content, features, and functionality.
• "Service" refers to the astrological services provided through the App—including daily horoscopes, transit calendars, current transit alerts, compatibility analyses, tarot readings, the AI Astrological Advisor, and related educational content.
• "User" means any individual who accesses or uses the App, whether registered or not.
• "Account" refers to a registered user's profile and associated data within the App.
• "Content" includes all text, graphics, images, audio, video, software, and other materials in the App.
• "User Content" means any content submitted, posted, or transmitted by Users through the App.
• "Subscription" refers to paid access to premium features and content within the App.

By creating an Account, downloading, accessing, or using the App, you:

• Acknowledge that you have read, understood, and agree to be bound by these Terms.
• Represent that you have the legal capacity to form a binding contract (or, if under 18, have obtained parental/guardian consent).
• Consent to the collection and use of your personal information as described in our Privacy Policy.
• Agree to comply with all applicable laws and regulations.

If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3.1. AstroBella provides various astrological services, including:

• Birth chart generation and analysis based on user-provided birth data.
• Daily, weekly, and monthly horoscopes and predictions.
• Compatibility readings and relationship analyses.
• Transit alerts and notifications for planetary movements.
• Tarot readings for entertainment purposes.
• AI Astrological Advisor offering personalized interpretations (for entertainment only).
• Educational content about astrology and celestial phenomena.

3.2. Service Availability:

• We aim to keep the App available 24/7 but do not guarantee uninterrupted access.
• We reserve the right to modify, suspend, or discontinue any part of the Service without notice.
• Access to certain features may be limited or restricted at our discretion.

4.1. Account Creation and Security:

• Provide accurate, complete, and current information during registration.
• Maintain the confidentiality of your account credentials.
• Notify us immediately of any unauthorized access or security breach.
• You may not share your account credentials or transfer your account.

4.2. Birth Data Accuracy:

• Ensure that your birth date, time, and location information is accurate.
• Inaccurate data may affect the accuracy of astrological readings.
• We are not responsible for readings based on incorrect birth data.

4.3. Account Termination:

• We reserve the right to suspend or terminate accounts for violations of these Terms.
• You may terminate your account at any time via the App settings, which may result in loss of data.

5.1. Subscription Plans:

• Free tier with basic features and limited access.
• Premium subscription offering full access to all features.
• Special promotional plans may be offered periodically.

5.2. Payment Terms:

• Subscription fees are charged via your device's app store account.
• Payments are processed in accordance with your app store’s terms and policies.
• Prices are subject to change with prior notice.
• Fees are non-refundable except as required by applicable law.

5.3. Subscription Management and Cancellation:

• Subscriptions automatically renew unless canceled at least 24 hours prior to renewal.
• You can manage and cancel subscriptions through your device's app store settings.
• For consumers within the EU, you have the statutory right to cancel this contract within 14 days (the "Right of Withdrawal"). However, if the performance has begun with your express consent and acknowledgment that you lose your right to withdraw, this shall be indicated at the time of subscription.

5.4. Trial Periods:

• Trial offers are limited to one per user.
• Unused trial periods are forfeited upon purchase of a subscription.
• We reserve the right to modify or terminate trial offers.

6.1. Acceptable Use:

• Use the App in compliance with all applicable laws.
• Respect the privacy and rights of other users.
• Avoid unauthorized access or tampering with the App's systems.
• Do not use the App for any unauthorized commercial purposes.

6.2. Prohibited Activities:

• Reverse engineering, decompiling, or otherwise attempting to extract the source code.
• Uploading or transmitting viruses or malicious code.
• Interfering with or disrupting the Service or its servers.
• Creating multiple accounts for abusive purposes.
• Impersonating others or providing false information.

7.1. App Content:

• The App and its original content, features, and functionality are owned by AstroBella and are protected by international intellectual property laws.
• This includes, but is not limited to, astrological algorithms, interpretation texts, graphics, images, design elements, and educational materials.

7.2. License to Use:

• We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
• You may not copy, modify, create derivative works of, or distribute any App content for commercial purposes.

7.3. User Content License:

• You retain ownership of any content you submit to the App.
• You grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your content.
• This license survives the termination of your account.

8.1. Nature of Services:

• All astrological readings, predictions, tarot readings, and interpretations are provided for entertainment and personal growth purposes only.
• They should not be considered professional advice in medicine, finance, legal matters, or any other specialized field.

8.2. Accuracy and Interpretation:

• Astrological calculations are based on user-provided data, traditional astrological principles, and modern interpretative methods.
• Results may vary and should not be solely relied upon for making important life decisions.

8.3. AI Astrological Advisor:

• The AI Astrological Advisor is an automated service that uses algorithms and machine learning to provide personalized astrological insights. It is offered for entertainment purposes only.
• We do not guarantee the accuracy or reliability of any information provided by the AI Advisor. Reliance on such information is solely at your own risk.

9.1. Disclaimer of Warranties:

• The App is provided "as is" and "as available" without any express or implied warranties.
• We do not guarantee uninterrupted or error-free service, nor the accuracy of astrological calculations and interpretations.

9.2. Limitation of Liability:

• To the fullest extent permitted by law, Moonphase Apps GmbH shall not be liable for any direct, indirect, consequential, or incidental damages arising from your use of the App. This limitation applies to damages related to data loss, business interruption, or personal injury, except where such limitations are prohibited by mandatory legal provisions.

10.1. Informal Resolution:

• Before initiating any formal dispute resolution process, you agree to contact us and attempt to resolve any issues informally over a period of 30 days.

10.2. Arbitration and Jurisdiction:

• For non-consumer disputes, any unresolved dispute shall be resolved by binding arbitration under the JAMS Streamlined Arbitration Rules, with the arbitration conducted in English. The arbitration venue shall be San Francisco, California.
• Note for EU Consumers: Nothing in these Terms shall limit your statutory rights under German or EU law. In particular, arbitration provisions may not apply if they conflict with mandatory consumer protection laws.

10.3. Class Action Waiver:

• You waive any rights to participate in class actions or collective arbitrations and agree not to act as a private attorney general, except where such a waiver is not permitted by law.

• These Terms shall be governed by and construed in accordance with the laws of the State of California for non-consumer disputes.
• Notwithstanding the above, for consumers residing in Germany or the EU, mandatory provisions of German/EU law shall apply.
• The United Nations Convention on Contracts for the International Sale of Goods shall not apply.

• We reserve the right to modify these Terms at any time. Changes will be effective upon posting on the App.
• Material changes will be communicated via email, in-app notifications, or update notes.
• Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.

• The App may contain links to third-party websites or services that are not under our control.
• We are not responsible for the content or practices of any third-party services. Your use of such services is subject to their respective terms and policies.

You agree to indemnify, defend, and hold harmless Moonphase Apps GmbH, its affiliates, officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

• If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
• These Terms constitute the entire agreement between you and Moonphase Apps GmbH regarding your use of the App, and supersede any prior agreements.

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including natural disasters, governmental actions, or other unforeseen events.
